1. TERMS & CONDITIONS 

Welcome to Evolvex Solutions.
By purchasing our digital services—including but not limited to chatbots, AI agents, automation workflows, CRM integrations, web creation, branding, or any related consulting—you agree to the following Terms & Conditions.

1. Nature of Services

Evolvex provides digital, non-tangible services that require custom work, creative labor, and technical development.
No physical items are shipped.

Each service is delivered based on the product description, agreed scope, and client onboarding information.

2. Scope of Work

Each service or package includes a clearly defined scope.
Anything outside this scope is considered additional work and may incur additional fees.

Evolvex does not provide unlimited revisions, support, or modifications unless explicitly stated.

3. Delivery Timeline

Delivery timelines begin after the client submits all required information, such as onboarding forms, platform access, brand materials, credentials, or copy.

Client delays extend the delivery timeline.

Evolvex is not responsible for delays caused by:

  • Lack of access
  • Incomplete information
  • Client non-responsiveness
  • Third-party platform issues

4. Client Responsibilities

Clients agree to:

  • Provide accurate and complete information
  • Grant necessary platform access (CRM, email, social platforms, Zapier, etc.)
  • Respond to communication in a timely manner
  • Ensure compliance with local laws, including data privacy (GDPR, CCPA, etc.)

Failure to provide required access may pause the project without refund.

5. Revisions & Change Requests

Each service includes a specified number of revisions.
Additional revisions or changes outside the original scope will incur additional charges.

6. Payments

All payments are processed through Shopify and must be made in full before work begins, unless otherwise specified.

No work begins until payment is completed.

7. Refund Policy

Evolvex offers refunds only if the project has not begun and no onboarding materials have been submitted.

Due to the digital and custom nature of our services, once work has begun no refunds will be issued.

8. No Guarantee of Business Outcomes

Evolvex does not guarantee:

  • Sales increases
  • Lead volume
  • Conversion rates
  • Revenue improvements
  • Any specific business outcome

Tools like chatbots, AI agents, and automations can enhance operations but are subject to many business factors outside our control.

9. AI & Automation Limitations

AI may occasionally generate inaccurate or inappropriate responses.
Client agrees to:

  • Monitor outputs
  • Review automations
  • Ensure responses meet their brand and compliance standards

Client is solely responsible for the deployment and use of any AI systems.

10. Third-Party Tools

Evolvex uses third-party tools such as CRM platforms, Meta, Zapier, Google, and others.

We are not responsible for:

  • Third-party outages
  • Changes to APIs
  • Rate limits or updates
  • Platform suspensions
  • Data loss caused by third-party providers

11. Intellectual Property

Upon final delivery and full payment, the client receives rights to use the delivered assets for their own business.

Evolvex retains rights to:

  • Internal frameworks
  • Automation logic
  • Templates
  • Reusable components
  • Proprietary tools or workflows

Evolvex may display work in portfolios unless client requests otherwise in writing.

12. Termination

If the client becomes unresponsive for more than 14 days, Evolvex may pause or terminate the project without refund.

Evolvex may terminate a project at any time due to:

  • Abuse
  • Fraud
  • Repeated scope violations
  • Violation of terms

In such cases, no refunds are provided.

13. Liability Limitation

Evolvex is not liable for:

  • Lost revenue
  • Lost profits
  • Client business decisions
  • System misuse
  • Data issues
  • Any indirect or consequential damages

Maximum liability is limited to the total amount paid for the service.

14. Updates to Terms

Evolvex may update these Terms at any time.
By using our services you accept the latest version.

AI-generated Content and Automation

Certain features of the Evolvex platform use artificial intelligence to generate responses, automate workflows, and assist users. While we strive to ensure accuracy and reliability, AI-generated outputs may occasionally contain errors, incomplete information, or unintended results.

Users should independently verify important information before relying on automated responses. Evolvex Solutions does not guarantee the accuracy, completeness, or suitability of AI-generated outputs for specific purposes.
